Pan-Am Dental LLC – SMS and MMS Communication Policy

By using Pan-Am Dental LLC services, including enrolling in our text messaging communications (SMS and MMS), you expressly consent to the collection, use, and sharing of your personal information as described in our Privacy Policy and Terms of Service. You acknowledge that you have read, understood, and agree to our Terms of Service and Privacy Policy, including terms related to data collection, communication, and security.

1. Description of Messaging Service
By opting into Pan-Am Dental LLC’s text messaging services, you agree to receive Customer Care and Account notification related to our services, products, and patient communications. Message frequency may vary. Message and data rates may apply depending on your mobile carrier plan. Consent to receive text messages is not a condition of purchase or service.

2. Opt-Out Instructions
You may opt out of receiving messages at any time by replying to any message with the word STOP. Once we receive your opt-out request, we will promptly remove your number from our messaging list. You may still receive transactional and informational messages related to active patient cases or orders as necessary for service fulfillment.

3. Help Instructions
For help or more information, reply “HELP” to any message.

4. Use and Protection of Your Information
We use your personal information solely to provide, maintain, and improve our services, process transactions, and communicate with you. We do not sell, rent, or share your mobile information with third parties for marketing purposes. We may share your data only with trusted third-party service providers for the sole purpose of delivering SMS/MMS messages on our behalf, or as required by law.

5. HIPAA and Patient Confidentiality
By subscribing to this messaging service, you confirm that you are the care provider or authorized recipient of patient information. You are responsible for maintaining the confidentiality of any patient information received on your personal device. Pan-Am Dental LLC is not liable for unauthorized access, disclosure, or breaches of patient information due to device compromise or mishandling.

6. Carrier Disclaimer
Wireless carriers are not liable for delayed or undelivered messages. Delivery of text and multimedia messages is subject to effective transmission by your mobile carrier and cannot be guaranteed.

7. Security and Retention
Your personal information is stored securely and is accessible only by authorized personnel. We implement administrative, technical, and physical safeguards to protect your information. We retain your information only as long as necessary to provide our SMS/MMS services or as required by law.

Your continued use of Pan-Am Dental LLC services constitutes your ongoing consent to these terms. We reserve the right to update this SMS and MMS Communication Policy as needed.

8. Agreement to Receive SMS Messages 

By providing your mobile number, you agree that Pan-Am LLC may send you periodic SMS messages containing updates on system interruptions. Opt-In Message method is a verbal agreement by customer and Pan-Am Dental LLC.  Message frequency depends on our need to communicate any disruptions with you.  You may unsubscribe at any time by replying STOP.  For help, reply with the word HELP.  Message and data rates may apply.  You agree to notify us of any changes to your mobile number and update your account with us to reflect this change.  Data obtained from you in connection with the SMS service may include your cell phone number, your carrier’s name, and the date, time and content of your messages, as well as other information that you provide.  We may use this information to contact you and to provide the services you request from us. By subscribing to or otherwise using the service, you acknowledge and agree that we will have the right to change and/or terminate the service at any time, with or without cause and/or advance notice.

Will I be charged for the text messages I receive? We will never charge you for the text messages you receive, depending on your phone plan, you may see some charges from your mobile provider.  Please reach out to your wireless provider if you have questions about your text or data plan.

9.Health Data Collection, Use, and Disclosure

Pan-Am Dental LLC may access, collect, and process certain health-related information in the course of providing our services. This information may include, but is not limited to, patient names, case details, treatment information, dental scans, and other data necessary to fulfill dental laboratory services.

We use this information strictly for the following purposes:

  • To provide, manage, and fulfill dental laboratory services
  • To communicate with dental professionals regarding cases and orders
  • To improve service quality and operational efficiency
  • To comply with applicable legal and regulatory requirements

We do not sell or rent health data to third parties. Health-related information is only shared with authorized personnel, affiliated partners, or service providers as necessary to deliver our services and operate our business, and always in accordance with applicable privacy laws and regulations.


10.Data Retention and Deletion

We retain personal and health-related data only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.

If you wish to request the deletion of your personal or health-related data, you may do so by contacting us at info@panamdl.com. Upon receiving a verified request, we will:

  • Delete or anonymize your data within a reasonable timeframe, unless retention is required for legal, regulatory, or operational purposes
  • Notify you once the deletion request has been completed

Please note that certain data may be retained as required to comply with legal obligations, resolve disputes, or enforce our agreements.
